Eric Poland

Attorney

Eric represents clients, from the Fortune 100 to founders, in intellectual property matters within the US and internationally. He advises clients in all aspects of intellectual property law from obtaining and building intellectual property portfolios to defending or asserting rights against other parties.

Education & Professional Background

Eric graduated from the Florida State University College of Law with Magna Cum Laude Distinction. At Florida State University, he served on Law Review, and as a trademark research assistant. During his studies, in addition to gaining a deep appreciation and understanding of intellectual property law, he earned a certificate in Environmental and Land Use Law.

Eric also earned a Bachelor of Science degree in construction engineering from Iowa State University.  He served as the treasurer for the Construction Engineering Honor Society while at Iowa State University.  Before completing his studies at Florida State University and Iowa State University, he was admitted to and completed a year of study as a midshipman at the United States Naval Academy.

Previously he worked at a large international law firm.  He was responsible for directly advising stakeholders regarding intellectual property matters and assisting clients in building international intellectual property portfolios.  In addition, he mentored and led associates and agents to accomplish clients’ objectives.

Patent Expertise

Having prepared, filed, and prosecuted hundreds of patent applications, he has extensive experience assisting clients in understanding and obtaining valuable, litigation quality patents.  He concentrates on matters in the mechanical arts but has experience with patents across various fields including mechanical arts, computer science, and electrical disciplines.  Eric has experience in a broad range of technologies including construction methods and products, consumer products, personal care items, semiconductor and solar manufacturing and systems, industrial power generation systems, motors, precision agricultural equipment, computer security systems, HVAC systems, additive manufacturing systems, and robotics.

Engineering Experience

Prior engineering experience gives him added perspective in providing practical solutions when working with entrepreneurs, inventors and design engineers.  Prior to law school, he worked as a project engineer constructing healthcare facilities, commercial buildings, and living facilities.  He passed the fundamentals of engineering exam and was recognized as a certified engineering intern.

Representative Legal Experience

Eric has experience collaborating with companies of any size.  For example, Eric assisted in developing the patent portfolio of a Fortune 100 company by drafting and successfully prosecuting patents on technologies including robotics, additive manufacturing, generators, and inspection systems.

He also developed and grew an intellectual property portfolio for a startup company in the cyber security space.  He identified key values for the company and prepared and prosecuted patent applications to build value for the client.  He obtained the first patent for the company within one year of receiving a disclosure to help the company continue strategic growth.

Eric developed a patent portfolio for a construction products client that was in business for decades but did not have any prior patents.  He guided the client through protection of emerging technologies for their space and built a portfolio around their key product’s release.

In addition, Eric performed prior art analysis and routinely advised a large international company regarding product development and launches in very crowded technology fields.  He directly interacted with engineers to ensure that the products were protected, and the client’s risks were understood and minimized.

Community Service

Eric is deeply committed to serving others. For years he has been actively involved in the USPTO pro bono program to provide free legal services to inventors without the means to otherwise afford patent protection.

Eric is admitted to practice in Colorado and Missouri.  He is also admitted before the United States Patent and Trademark Office (USPTO).
