This site (together with any successor site(s), computer systems, cloud-based storage accounts, associated social media websites, and any of our mobile applications, any other websites or content owned by us, or any services provided by us, which link to this Privacy Policy, as defined below, hereinafter collectively referred to as the, or our, “Site”) is operated by Losey PLLC (“we,” “us,” or “Losey”).
We are concerned about privacy issues and want you to be familiar with how we collect, use and disclose information, so that you can make educated and informed decisions. This Privacy Policy (this, the, or our, “Privacy Policy”) describes how we collect, use, and disclose your personal information. Unless otherwise expressly indicated in this Privacy Policy, this Privacy Policy describes our collection, use, and disclosure of personal information through our Site.
Please note that the Privacy Policy applies only to our online information-gathering and dissemination practices in connection with the Site, and does not apply to any of our practices conducted offline. Your use, or accessing of, the Site is conditioned on your agreement with all the terms of this Privacy Policy, our Terms of Use posted on the Site (the, or our, “Terms of Use”), and any additional rules and guidelines that we post on the Site (any “Additional Terms”), regardless of how you access the Site (including but not limited to through the Internet, through a mobile network, or in any other manner). By using the Site, you are agreeing to the terms in the Privacy Policy, our Terms of Use, and any Additional Terms, both on your behalf, and, as applicable, on behalf of the company, government agency, or juridical entity with which you are affiliated or associated, and you represent and warrant that you have the authority to bind such entity to the Privacy Policy, our Terms of Use, and any Additional Terms. If you do not have such authority, or if you do not agree to the Privacy Policy, our Terms of Use, and any Additional Terms, then accessing the Site is strictly prohibited, and you must immediately exit and cease using the Site.
This Privacy Policy is written in the English language. We do not guarantee the accuracy of any translated versions of this Privacy Policy. To the extent any translated versions of this Privacy Policy conflict with the English language version, the English language version of this Privacy Policy shall control.
PLEASE READ THIS PRIVACY POLICY CAREFULLY TO UNDERSTAND HOW WE HANDLE YOUR INFORMATION. BY USING THE SITE, YOU ACKNOWLEDGE YOU HAVE READ AND UNDERSTAND THE PRIVACY POLICY AND THAT WE WILL COLLECT, USE, AND SHARE YOUR INFORMATION AS SET FORTH BELOW.
Children’s Privacy: No Users Under Eighteen Years of Age
The Site is not targeted for use by children. We will never knowingly request or collect personal information from any child. If you are under eighteen years old, please do not provide your personal information through the Site, even if you have obtained parental consent to do so. Likewise, no party is permitted to provide the personal information of another who is under eighteen years old.
Upon notification that a child has provided us with personally identifiable information, or that another party has provided us with a child’s personally identifiable information, we will delete the child’s personally identifiable information from our records. If you believe we might have any information from a child, please email us at privacy@losey.law.
Although we are not required to adhere to California data privacy laws, we make an effort to do so when possible. Under California law, if you are a California resident under the age of eighteen and you believe that your information has been provided to us, you may request us to remove content or information posted on our websites or stored on our servers by (a) submitting a request in writing to privacy@losey.law, and (b) clearly identifying the content or information you wish to have removed and providing sufficient information to allow us to locate the content or information to be removed. However, please note that we are not required to erase or otherwise eliminate content or information if: (i) other state or federal laws require us or a third party to maintain the content or information; (ii) the content or information was posted, stored, or republished by another user; (iii) the content or information is anonymized so that the minor cannot be individually identified; (iv) the minor does not follow the instructions posted herein on how to request removal of such content or information; or (v) the minor has received compensation or other consideration for providing the content. Further, nothing in this provision shall be construed to limit the authority of a law enforcement agency to obtain such content or information.
The Information We Collect and How We Collect It
“Personal Information” is information that identifies you as an individual, such as:
- name;
- physical mailing address;
- telephone number;
- email address.
We and our service providers generally collect and receive your personal information through the Site in three ways: (1) when you voluntarily provide personal information to us directly, such as when you fill out a contact form on the Site; (2) through automated processes that collect information about your use of the Site; and (3) when we receive information about you from third-party sources, such as other individuals who may provide your personal information to us through the Site. These methods, and the personal information we collect, are described in more detail below.
Information You Provide Directly
When you use or access the Site, send us an email, or otherwise contact us, we may collect personal information that you choose to provide directly, such as your name; email address; other contact information, such as the city and state in which you are located; and any other information that you choose to provide as part of a request or inquiry, including any details that you choose to provide us relating to legal needs or questions.
Sending us information through the Site does not create an attorney-client relationship, guarantee any results, obligate us to provide legal advice to you, or require us to treat such information confidential or privileged. This is true even if you inform us that you consider such information to be confidential or privileged.
We do not collect, or accept at the firm, credit card information. Do not provide credit card information to anyone who represents themselves as a member of the firm, as we do not accept or collect such information from clients or others.
If you are a career seeker and use the Site to contact us about working with Losey, or if you are an employee, owner, director, officer, or contractor of Losey (individually referenced in this Privacy Policy as “employee” and collectively referenced as “employees”), we may collect information that includes educational, professional, and employment-related information, such as your resume, cover letter, location, and any other information you choose to provide in employment inquiries or applications, including certain sensitive personal information.
If you are an employee, we also collect and process personal information, including the categories of sensitive personal information described above, for employment-related purposes such as determining your eligibility for a position with the company; managing compensation, benefits, and employment-related expenses; managing professional development, performance, and conduct; protecting the company against illegal activity and other misconduct; undertaking activities to verify and maintain the quality, safety, and performance of our products and services; and complying with our legal obligations.
Unless you are an employee, or as otherwise stated in a separate agreement, Losey does not collect sensitive personal information such as your social security, driver’s license, state identification card, or passport number; your financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; your racial or ethnic origin, religious or philosophical beliefs, or union membership; the contents of your mail, email and text messages, unless we are the intended recipient of the communication; your genetic data; your biometric information for the purpose of uniquely identifying you; and personal information collected and analyzed concerning your sex life or sexual orientation. We ask that you not send us, and that you not otherwise disclose to us, any sensitive personal information on or through the Site or otherwise to us.
We take commercially reasonable measures to ensure we collect and process the minimum amount of personal information from you that is necessary to conduct our business; communicate with you; provide you with web-based and mobile applications, customer support, and identity verification; provide you with information on our services and content, website maintenance, and improvements; and comply with legal requirements.
Information We Collect Automatically
We also may collect certain other information automatically when you use the Site, such as the following:
- browser and device information, such as device identifiers like IP addresses or MAC addresses, operating system information, browser information, usage information including the pages you visited and how long you viewed them, searches, links you click on, and other information about your interaction with the Service and other online services;
- information stored in web-based technologies like cookies (more information about our use of cookies follows later in this Privacy Policy), pixel tags, log files, or web beacons, including browser type, portions of the online services visited, time spent on the online services, pages visited, referring URLs, links you click on, and other traffic and usage data.
- Information collected in connection with analytics technologies, such as Google Analytics and other similar technologies, that permit us to learn more about how visitors use our online services. - Information that indicates your general location, including your IP address.
When you use the Site, third parties with whom we work may use cookies and other similar technologies to collect this information and other information about your online activities over time and across third-party websites or online services.

- aggregated or anonymized information.
Information We Receive from Third Parties
We may also receive information about you from third parties who use the Site to submit your information to us, such as in connection with legal inquiries or requests. That information may include any information that the third party chooses to provide to us, which may include your personal information.
By using the Site, you agree that you will only provide the information of another party to the extent that you have the other party’s consent to do so. Additionally, you are strictly prohibited from providing any information about anyone under the age of 18, and under no circumstances may you submit any sensitive personal information, whether about yourself or about others, age and consent notwithstanding. If we receive any such information, we will delete it.
How We May Use Personal Information
We may use personal information that we collect for purposes that include the following:
- To communicate with you, including responding to your inquiries and fulfilling your requests;
- To provide the Site to you and others;
- To send you our legal updates and mailings relating to our seminars or events that we think may be of interest to you;
- To keep a record of your contact information and correspondence, and use it to respond to you, if you contact us through the Site;
- To send administrative information to you;
- To allow you to send Site-related content to a third party through the Site. By using this functionality, you affirm that you are entitled to use and provide us with said third party’s name and email address;
- For our business purposes, such as data analysis, audits, enhancing, improving or modifying our Site, identifying usage trends, determining the effectiveness of our promotional campaigns, operating and expanding our business activities, and performing other internal business operations, including as described elsewhere in this Privacy Policy;
- Creating aggregate or deidentified data;
- Maintaining the safety, security, and integrity of our Site, applications, technology assets, services, and our business;
- Protecting against malicious, deceptive, fraudulent, illegal, or other unauthorized activity, and participating in any prosecution or enforcement of laws or agreements meant to prevent or punish such activity;
- Protecting the legal rights, property, safety, and security of our organization, workforce, users, clients, and others;
- Complying with applicable law, other legal requirements, and industry standards;
- As we believe to be necessary or appropriate to comply with legal process, respond to requests from public and government authorities including public and government authorities outside your country of residence, enforce our Privacy Policy, Terms of Use, and Additional Terms, and any obligations therein, protect our operations or those of any of our affiliates, protect our rights, privacy, safety or property, or that of our affiliates, you or others, and to allow us to pursue available remedies or limit the damages that we may sustain;
- For such other purposes as you may authorize.
How Personal Information May Be Disclosed
To accomplish the purposes set out above, we may disclose personal information we collect about you in the following ways:
- To our affiliates for the purposes described in this Privacy Policy, consistent with our goal of providing the highest level of service. Subject to local requirements, this information may be used to provide legal and related services offered by our other legal entities and for all the purposes outlined in this Privacy Policy. Losey PLLC remains responsible for the management of the jointly used personal information;
- To our third-party service providers that provide services such as website hosting, Site-related consulting and monitoring, data analysis, information technology and related infrastructure, customer service, email delivery, auditing and other similar services;
- To identify you to anyone to whom you send messages through the Site;
- To a third party (whether affiliated or unaffiliated with us) in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings);
- As we believe to be necessary or appropriate to comply with legal process, respond to requests from public and government authorities including public and government authorities outside your country of residence, enforce our terms and conditions (including this Privacy Policy, our Terms of Use, any Additional Terms, contracts, and other legal rights), protect our operations or those of any of our affiliates or others against malicious, deceptive, fraudulent, illegal, or other unauthorized activity, protect our rights, privacy, safety or property, or that of our affiliates, you or others, and to allow us to pursue available remedies or limit the damages that we may sustain;
- To debug, identify, and repair errors, effectuate similar functional enhancements, and improve the Site;
- To such other parties, or for any other purpose, as you may authorize.
Third parties are prohibited from using your personal information beyond providing services to us and are required to maintain the information’s confidentiality and privacy. Losey does not trade, rent, or sell your personal information to third parties, share your personal information with third parties for cross-context behavioral advertising, or process it for targeted advertising or consumer profiling, and in the preceding twelve months we have not sold or shared any personal information.
We may also share or disclose your personal information if we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, dissolution, sale of all or a portion of our assets, or transition of service to another provider (collectively a “Transaction”). Your personal information may be shared in the diligence process with counterparties and others assisting with the Transaction, and transferred to a successor or affiliate as part of or following that Transaction along with other assets. In such a case, unless prohibited by applicable law, your information would remain subject to the Privacy Policy applicable at the time of such transfer, unless you discontinue use of the Site.
We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.
Your personal information may be disclosed by you on services to which you are able to post information and materials. Please note that any information you post or disclose online may become public information, and may be available to us, to users of the Site and to the general public. We urge you to be very careful when deciding to disclose your personal information, or any other information, on the Site or any other services.
Non-Personally Identifiable Information
Please note that we may use and disclose information which does not directly relate to an individual or reveal their specific identity (such as browser and device information, usage data, IP addresses, etc.) for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat such information as personal information under applicable law, then we may use and disclose it for all the purposes for which we use and disclose personal information. In some instances, we may combine non-personally identifiable information with personal information (such as combining your name with your geographical location). If we combine any non-personally identifiable information with personal information, the combined information will be treated by us as personal information as long as it is combined.
Choices and Access
Your choices regarding our use of your Personal Information for marketing purposes
If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out of receiving these marketing-related emails by following the unsubscribe instructions in any such message or by contacting us by email at privacy@losey.law. We will try to comply with your request as soon as reasonably practicable. Please note that if you do opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, and you cannot opt-out from receiving administrative messages.
How you can access, change or suppress your Personal Information
You may request to review, correct, update, delete, or otherwise modify any of your personal information that you have previously provided to us through the Site, or object to the use or processing of such personal information by us. You may exercise these rights by contacting us via email at privacy@losey.law.
In your request, please make clear what personal information you would like to have changed, whether you would like to have your personal information that you have provided to us removed from our database or otherwise let us know what limitations you would like to put on our use of your personal information that you have provided to us.
For your protection, we may only implement requests with respect to the personal information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.
Please note that we may need to retain certain information for recordkeeping purposes or other legal obligations, and there may also be residual information that will remain within our databases and other records, which will not be removed or altered.
Please note that, in some cases, if you object to the use or processing of your personal information, or if you decide not to provide information we request through the Site, we may not be able to provide some or all of the Site or to otherwise fulfill your inquiries or requests.
In the event that you object to our collection, use, or processing of your information, we will not be able to guarantee that any third parties cease their collection, use, or processing of your information.
Cookies and Other Technology
We may use cookies, web beacons, pixel tags, mobile analytics software, log files, or other technologies to collect certain information about your online activity and interactions with the Site which allows us to keep track of analytics and certain statistical information that enables us to improve our services and provide you with more relevant content and advertising.
Some of the cookies we use are necessary to enable you to move around the Site and use its features. We also use functional cookies to record information about the choices you have made and to allow us to tailor the Site to our users; for example, to remember your language or region or that you have already completed a survey. This information is usually anonymized and is not used for any other purpose. We may also use analytic services (such as Google Analytics, described above) to help us understand how effective our content is, what interests our users have, and to improve how the Site works. In addition, we use web beacons or tracking pixels to count visitor numbers and performance cookies to track how many individual users access the Site and how often. This information is used for statistical purposes only, and we do not use such information to personally identify any user.
You may, however, disallow receiving cookies at any time through your web browser. Similarly, you may set your mobile device to refuse to provide certain information, but certain features of the Site may not work without such information. It is not our intention to use cookies to retrieve information that is unrelated to our Site.

The Site may include links to websites, applications, and services operated by third parties (each a “Linked Site”), either on our behalf or on their own behalf, that are subject to their own privacy policies. We encourage you to review those privacy policies, which apply to the information collected by those websites, applications, and services. Please be aware that the terms of this Privacy Policy do not apply to these Linked Sites or their content, or to any collection of your personal information by third parties through the Linked Sites. Losey is not responsible for the privacy practices or the content of such Linked Sites. Please be aware of where you are at all times.
When you click on a link to a Linked Site, you will leave our Site and go to that Linked Site, and another entity may collect personal information or anonymous data from you. We have no control over, do not review, and cannot be responsible for, these Linked Sites or their content. Losey expressly disclaims any liability that may arise from your use or provision of any of your information whatsoever to Linked Sites. You understand and agree that by clicking on a link to a Linked Site that you have left our Site.
Security
The security and confidentiality of your personal information is important to us. We follow reasonable commercial standards for organizational, technical, and administrative measures to protect the personal information submitted to us, both during transmission and once it is received.
Please be advised, however, that while we take reasonable security measures to protect your personal information, such measures cannot be guaranteed to be secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your personal information. The security of your account relies on your protection of your user profile information.
We will never ask you to send any password or other sensitive information to us in an email. Any email or other communication purporting to be from one of our websites requesting any password or asking you to provide sensitive account information via email, should be treated as unauthorized and suspicious and should be reported to us immediately. If you believe someone else has obtained access to your password, please change it immediately.
If you believe any personal information you have submitted to us is unsecure or that someone has accessed your account, please notify us immediately at privacy@losey.law.
Consent to Processing and International Transfer
The Site is controlled and operated by us from the United States, and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Losey may process, transfer, and store your information on servers located in the United States. As a result, your personal information may be subject to data protection and other laws that may differ from your country of residence. Your personal information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the countries in which we operate. By using the Site, or by providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside or are a citizen.
Your personal information may additionally be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Site you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than those of your country.
State-Specific Notices
Certain states (listed in the “Special Notice” sections below) provide additional data privacy rights to users within those states. These state-specific laws do not neccesarily apply to Losey or the Site, and we are thus not neccesarily required to adhere to these state-specific data privacy laws. However, we nonetheless strive to recognize such data privacy rights, and aim to adhere to the following state-specific laws.
Special Notice for California Residents
If you would like to submit a Consumer Request, you can contact us at privacy@losey.law. If you choose to submit a Consumer Request, you must provide us with enough information to identify you (e.g., your first and last name, email address, and telephone number) and enough specificity on the requested data. We will only use the information we receive to respond to your request. We will not be able to disclose information if we cannot verify that the person making the Consumer Request is the person about whom we collected information, or someone authorized to act on such person’s behalf. We will verify your request by comparing the information you provide with the information we have on you and, if your request is submitted by an authorized agent, we will require you to provide signed, written permission for such agent to act on your behalf.
“Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. “Personal information” does not include publicly available information.
- Request to Correct. You may correct or update your personal information at any time by logging into your account or by contacting us.
- Request to Access. You may submit a Consumer Request to obtain a copy of or access to the personal information that we have collected on you.
- Request to Know. You may submit a Consumer Request to receive information about our data collection practices.
° Right to Know what Personal Information is being Collected. You may request information on the categories of personal information we have collected about you; the categories of sources from which the personal information is collected; our business or commercial purpose for collecting, selling, or sharing personal information; the categories of third parties to whom we have disclosed personal information, if any; and the specific pieces of personal information it has collected about you.
° Right to Know what Personal Information is being Collected. You may request information on the categories of personal information we have collected about you; the categories of sources from which the personal information is collected; our business or commercial purpose for collecting, selling, or sharing personal information; the categories of third parties to whom we have disclosed personal information, if any; and the specific pieces of personal information it has collected about you.
° Right to Know what Personal Information is Sold or Shared and to Whom. You may also request the categories of personal information that we have collected about you; the categories of personal information that we have sold or shared about you and the categories of third parties to whom the personal information was sold or shared, by category or categories of personal information for each category of third parties to whom the personal information was sold or shared, and the categories of personal information that we have disclosed about you for a business purpose and the categories of persons to whom it was disclosed for a business purpose.
Please note that the categories of personal information, sources, and disclosure will not exceed what is contained in this Privacy Policy. Additionally, we are not required to retain any information about you if it is only used for a one-time transaction and would not be maintained in the ordinary course of business. We are also not required to reidentify personal information if it is not stored in that manner already, nor is it required to provide the personal information to you more than twice in a twelve-month period.
- Request to Limit the Use of Your Sensitive Personal Information. We do not collect, use, or disclose sensitive personal information, unless you are an employee, in which case we collect, use, and disclose certain sensitive personal information only for employment-related purposes reasonably expected by employees. However, if you believe that we may have collected sensitive personal information about you, you may request that we limit the use or disclosure of your sensitive personal information.
- Request to Delete. You may request that we delete personal information we have collected from you. Subject to certain exceptions set out below we will, on receipt of a verifiable Consumer Request, delete your personal information from our records, direct any service providers to do the same, and notify all third parties to whom we have shared your personal information to delete it unless this proves impossible or involves disproportionate effort. Please note that we may not delete your personal information if it is necessary to:
° Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by the consumer, or reasonably anticipated by the consumer within the context of a business’ ongoing business relationship with the consumer, or otherwise perform a contract between the business and the consumer.
° Help to ensure security and integrity to the extent the use of the consumer’s personal information is reasonably necessary and proportionate for those purposes.
° Debug to identify and repair errors that impair existing intended functionality.
° Exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law.
° Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
° Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the business’ deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if the consumer has provided informed consent.
° To enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with the business and compatible with the context in which the consumer provided the information.
° To Comply with a legal obligation.
- Right to Access Information About Automatic Decision-Making. We do not currently engage in automated individual decision-making. However, in the event we ever do so, we will inform you of such change and you may request information about and opt out of such automated decision-making.
- Right to Data Portability. You may also request that we transfer your personal information to another entity, to the extent such transfer is technically feasible.
We may not, and will not, treat you differently because of your Consumer Request activity. As a result of your Consumer Request activity, we may not and will not deny goods or services to you; charge different rates for goods or services; provide a different level quality of goods or services; or suggest any of the preceding will occur. However, we can and may charge you a different rate, or provide a different level of quality, if the difference is reasonably related to the value provided by your personal information.
Special Notice for Nevada Residents
We do not sell, rent, or lease your personally identifiable information to third parties. However, if you are a resident of Nevada and would like to submit a request not to sell your personally identifiable information, you may do so by emailing us at privacy@losey.law.
Special Notice for Virginia Residents
Personal information or “personal data” means “any information that is linked or reasonably linkable to an identified or identifiable natural person.” “Personal data” does not include de-identified data or publicly available information.
- Request to Access. You may submit a request to confirm or to obtain a copy of or access to the personal data that we have collected on you including what the data is, how it’s been used, and who it’s been disclosed to. Your personal data may no longer be available because it has been destroyed, erased, or made anonymous in accordance with our data retention policies in which case we will provide you with the reasons why the personal data no longer exists where possible.
- Request to Correct. You may correct or update your personal data at any time by logging into your account or by contacting us.
- Request to Delete. You may request that we delete the personal data provided by or obtained about you. We will delete your personal data from our records and direct any service providers to do the same unless retention is required by law.
- Request to Opt-Out. You may submit a request to opt out of the sale of your personal data as well as its processing for targeted advertising or consumer profiling. We do not sell, rent, or lease your personal data to third parties and do not process your personal data for targeted advertising or consumer profiling.
- Appeal. If we notify you that no action is to be taken in response to your request to access, correct, delete, or opt-out, you may appeal this decision by contacting us within 30 days with the reason why you believe further action should be taken. If you are not satisfied with the result of the appeal, you may contact the Virginia Attorney General or submit a complaint online at https://www.oag.state.va.us/consumer-protection/index.php/file-a-complaint.
- Withdraw Consent for Your Sensitive Personal Information. You may withdraw your consent to any use or disclosure of your personal sensitive information.
