We provide alternative dispute resolution that goes beyond simple negotiation or traditional mediations. Our private judicial and arbitration services group are able to provide fair and quick resolutions to parties.
Under Section 44.104 of the Florida Statutes, you can choose an attorney to serve as a private judge to try your case and provide you with a resolution in rapidly and fairly. Our team includes a highly-respected former circuit court judge, and an experienced AAA Certified Arbitrator who sits on panels for both Commercial and Employment disputes.
Our team is available to serve as your private judge or arbitrator in a wide variety of matters. Our private judges will be available on your schedule to move your case to conclusion and will work diligently to deeply understand the factual and legal issues, as well as to issue rulings promptly.
In their role as a private judge, our team will meet with the lawyers and their clients to enter a case management plan. Hearings and trials can be easily set at times that are convenient to the parties and counsel. Rather than compete with hundreds, if not thousands of additional cases before the Courts, our private judges will be able to move your case forward quickly towards a rapid, but measured response.
A case heard by a private judge is governed by the Florida Rules of Evidence and results in a final judgment that is filed with the Clerk of the Court. Any party may enforce a final decision rendered by a private judge by filing a petition for final judgment in the circuit court where the voluntary trial took place. Also, any party may appeal any legal ruling made by the private judge to the appropriate appellate court.
For arbitral matters, arbitration hearings, either in-person or remote, can be conducted under formal AAA Administration and applicable arbitration statutes, or per agreement of parties. Arbitration is well-known and has the benefit of evidentiary and procedural informality with little to no appellate procedures to delay finality.
